At Cukjati Law Firm, we prioritize personal attention and the care every case deserves. Jacob Cukjati founded the firm and brings deep roots in San Antonio. Curtis Cukjati, of counsel, has tried civil cases in Texas since 1989 and has held an AV Preeminent rating since 2011.

8 Signs You Have a Personal Injury Case

Most people who call us are not sure. That is the normal position to be in, and it is not something you are expected to work out on your own.

The process

How we work with our personal injury clients

People hesitate to call because they do not know what they are starting. So here is the whole process, start to finish, with realistic timeframes.

  1. You call, and you speak to a lawyer

    Same day

    Not a call center and not a script. You tell us what happened and we tell you honestly whether you have a case. If you do not, we say so and say why.

  2. We investigate and preserve

    Weeks 1–4

    We pull the crash report, send preservation letters before footage is overwritten, find every applicable policy, and take witness statements while witnesses can still be found.

  3. You treat, we handle the rest

    Months 1–9

    Your job is to get better and keep your appointments. We deal with the adjusters, the bills and the paperwork.

  4. We value the case

    At maximum medical improvement

    Once your doctors can say where your recovery has landed, we can value the claim accurately, future care included. Valuing it earlier is guesswork, which is why early offers run low.

  5. Demand and negotiation

    1–3 months

    We present the medical evidence and the legal basis, then negotiate. Most cases resolve here or shortly after.

  6. Suit and mediation, if needed

    9–18 months

    If the offer does not reflect what the case is worth, we file. Most filed cases still settle, usually at mediation. Filing is often what moves the number.

  7. Trial, if it comes to that

    As required

    A small share of cases are tried. We prepare every case as though yours will be, because a case visibly ready for trial settles for more.

Fees

What it costs

Nothing up front, and nothing at all unless we recover for you. We work on contingency: our fee is a percentage of what we obtain, and we advance the costs of building the case.

If we do not recover, you do not owe us a fee. You should have that in writing from any firm you consider, including ours. The fee agreement is where the details live.

How long you have

Most Texas injury claims must be filed within two years. Some are far shorter: a claim against a city, a transit authority, or a school district can require formal notice within six months, and sometimes less.

The deadline is rarely the real problem. Evidence is. Surveillance footage is overwritten in days, vehicles are repaired or scrapped, and witnesses become impossible to find. The case you have in week one is usually stronger than the same case in month six.

Questions we hear most

How much does it cost to talk to a lawyer?

Nothing. Consultations are free and there is no obligation. If we take your case, we work on contingency and there is no fee unless we recover for you.

How do I know if I have a case?

The short version: someone else’s carelessness caused you an injury that required treatment. If that describes your situation, call. Working out whether a claim is viable is our job, not yours.

How long do I have to file?

Usually two years in Texas. Claims against governmental entities can require notice within six months or less. Either way, evidence deteriorates long before any deadline.

Will I have to go to court?

Probably not. The large majority of injury cases settle. We prepare every case for trial regardless, because that is what produces a serious offer.

What if I was partly at fault?

You can still recover, provided you are not more than fifty percent responsible. Your recovery is reduced by your share. Do not assume you were at fault because an adjuster said so.

Do you speak Spanish?

Yes. Let us know when you call and we will make sure the conversation happens in the language you are most comfortable in.
